The Failure of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the crisis sparked by the introduction of a new 28-article proposal for ending the war appeared – briefly – to have been stabilised. A senior US official spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its response: an extensive attack of missile and drone strikes on Kyiv.

The Rhythm of Peace Talks and Military Action

The sequence of conflicting incidents captured the grim essence of the recent timeframe. By day, negotiation efforts are conducted: optimistic declarations are released from different nations. Significant resources is devoted on managing specific proposals. By night, the Kremlin clearly shows the world that, for them, conflict continues to be the primary tool for achieving "resolution".

Nocturnal Warfare

As military strikes developed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was revealed. Ukraine is equipped to monitor rocket firings from enemy soil, a capability afforded by current data. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to intercept incoming aerial threats roared overhead – sophisticated military planes supplied to Ukraine by European allies.

Soon thereafter, Kyiv's air-defence systems engaged: defensive missiles deployed against a Russian ballistic missile. This was a advanced protection mechanism at work, presumably supplied through Western nations. Every launch jolts you unexpectedly, rattling buildings. The moment of terror quickly transforms into resigned acknowledgment: possibly the approaching threat won't hit its mark this time, preventing destruction from ruin and another blackout.

Ongoing Risks

Soon after, a large-caliber weapon engaged a unmanned aircraft in the vicinity, part of a rapid response unit – almost certainly Western-made equipment. Sadly, the projectiles didn't strike the opposing UAV – it continued its flight toward its destination.

With pauses, this continued until dawn. Kyiv greeted the early updates: multiple fatalities, destruction and infrastructure problems in many homes as a result of the evening attack. As typically, everyone still maintained normal activities – experiencing conflict. But those 24 hours encapsulated Ukraine's essential dependence on Western support – a dependence that European nations are demonstrably unable to substitute in the short term.

Unsuccessful Negotiations

The detailed framework from US administration provoked deep reactions, controversy and serious worry – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and multilateral gatherings.

Every new proposal from US leadership unfolds according to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually achieve victory. This trend will, no doubt, endure.

Political Considerations

It is easy to blame particular leaders of consistently pushing Russian terms. But that does not seem to be the complete picture. Washington operates on a premise understood by experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The American government believes that it is impossible to compel Moscow to abandon the territory that it currently occupies in Ukraine's occupied territories.

The issue is that while recognising this factual reality, Washington does minimal to prevent Kremlin actions, through words or deeds, from thinking that the status quo will not change more in its advantage in the coming year.

Opposing Positions

Therefore, the Kremlin is convinced that time is on his side – that Ukraine and its allies are nearing depletion. Their incentive to accept conditions that does not give them the largest achievable advantage is almost completely absent. There may be numerous efforts to achieve ceasefire, but they will carry on as long as Russia's government remains completely certain in the conclusion.

On the contrary, Kyiv believes that Ukraine can still hold out, progressively conceding civilians and areas but averting a complete military breakdown until conditions improve in its favour.

Existing Situation

Realistically, there are no actual prerequisites for a truce. Now, subjective factors are entering the equation: leadership ambitions to broker a ceasefire and achieve global acclaim, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the country's interests against any plan Kyiv finds unacceptable, so that their attention does not shift toward internal issues. And although their mission will now be significantly challenging after recent developments, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are guiding negotiations.

Assessment and Future

It took a mere seven days to eliminate the suggested clauses of the current initiative. Forceful and unpredictable management of the matter by Washington, opposition by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, recent disclosures, all did their job.

While new proposals based on established approaches are approaching, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are rooted in Kremlin requirements and demonstrate specific hesitation to alter the situation, if they maintain solidarity and improve their protective measures at a much faster pace. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the predictable period, primarily depend on continued Western support.
